The CT mode makes it possible to establish the procedure for obtaining the relevant information and to require that employees working with it comply with measures to ensure its safety. A number of data cannot be classified. This is information about illegal actions of the administration, non-payment of wages, enterprise income, and the number of staff.

The procedure for establishing CT is as follows:

Compilation of a register of classified information and restrictions on its use, as set out in the regulation on commercial secrets. It specifies the name of the classified information, the circle of employees who have access to it, and the procedure for protecting this information.

Establishing sanctions for non-compliance with safety requirements.

Drafting of a local regulatory act.

The obligation not to disclose commercial secrets can be included in the employment contract. If it is absent, then it is necessary to draw up and sign a separate document with the employee. Of course, it is possible to make changes to the employment contract itself, but this often entails the need to change other terms, for example, the procedure for calculating wages.

Inclusion of a requirement for non-disclosure of certain information in agreements and contracts with counterparties.

Marking of tangible information carriers with the stamp "Commercial secret". In this case, an inventory is made, which indicates each carrier containing the relevant information.

Stages of introducing commercial secrets in a company

After these measures have been taken, confidential information will be under legal protection. An unscrupulous employee or counterparty can be required to pay compensation for damages in accordance with Article 139 of the Civil Code of the Russian Federation and even brought to criminal liability (Article 183 of the Criminal Code of the Russian Federation). The period during which the selected information is subject to the commercial secret regime is determined by the person who established it.
